Court of Protection Associate - 3 PQE+, Thames Valley, Legal 100

New - our client, a leading national Legal 100 firm are seeking an ambitious Court of Protection Associate  (3 PQE+) to enhance their highly regarded practice based in the Thames Valley.

The team act for a wide range of high-net worth individuals and families so this is an exciting opportunity to gain exposure to a varied and interesting caseload.

The team are collegiate and close-knit with a collaborative culture which consistently scores highly in employee engagement metrics.

Typical work ranges from making COP applications and drafting LPA's to assisting on more complex matters.

You will be a dedicated Court of Protection lawyer with experience of managing Property and Affairs Deputyships.

You will also have a solid understanding of the Professional Deputyship Standards, Mental Capacity Act (and its Code of Practice) and the Court of Protection Practice Directions.

You will work closely with the Department Head on a number of high value complex cases and will provide comprehensive legal advice and representation to the clients and family members.

 

Areas of work will be centred around the day-to-day management of Property and Affairs Deputyships, working with brain injured children and young adults. This includes:

 

  • Creating and monitoring of budgets to ensure sustainability and longevity of client funds.
  • Forecast forward spending Overseeing payments to clients and third parties while ensuring accurate management of schedules relating to those payments.
  • Supporting with the set up and management of care teams. Supporting with the sale and purchase of property and other high value assets.  Being actively involved in high value adaptation projects.
  • Routine day-to-day contact with clients, and their families, to provide individual support according to their needs Liaising with case managers, therapists, care teams, investment managers and other specialists.
  • Preparing all types of application to the Court of Protection to include Deputy appointment, ACC, urgent applications, and other applications for authority that may fall outside the Deputy’s general authority.
  • Preparation of annual deputyship reports
  • Preparations relating to Deputy visits
  • Assisting with setting up and managing bank accounts and investments Assisting with tax affairs
  • Statutory Wills Delegating and supervision of tasks where appropriate to paralegals and other junior team members.

We are seeking an experienced  Associate who can demonstrate a consistently strong academic record. You will have a genuine appetite for business development and marketing and be familiar, and confident, advising HNWI.

This team often handle high value deputyships and private trust work, preparing all types of applications to the COP including; Statutory Wills, Assisting in the purchase of properties and adapting them for the needs of the client, controlling and monitoring clients’ budgets, liaising with case managers, doctors, therapists, care teams, surveyors, architects, and other specialists,  supervising tax affairs and accounts, liaising with IFA’s, attending trustee meetings, taking notes and assisting with the preparation of trustee resolutions.

You may also be involved in the drafting of personal injury trusts.  The ability to take a proactive approach to marketing to assist in  securing further work for the CoP team is essential.
