The Competition and Markets Authority (CMA) is seeking two highly experienced Litigation Directors to lead and manage its litigation work. Our Litigation Group plays a central and increasingly important role in delivering successful outcomes across the CMA’s work – for example by defending our competition decisions on appeal, litigating to enforce consumer protection law, obtaining warrants to support our investigations and obtaining director disqualification orders. The volume and profile of the litigation we undertake has increased substantially in recent years and is expected to grow further in light of the expansion of our case work following EU Exit and the addition of new CMA functions. 

The Litigation Group acts for the CMA in all its civil litigation in the Competition Appeal Tribunal, High Court, Court of Appeal, Supreme Court and various other courts and tribunals.   Recent examples of our high-profile litigation include litigation in the Facebook/Giphy merger, the Tribunal decision in the Sabre/Farelogix merger, the McCann cartel litigation as well as Care UK in the Chancer division and our first contested disqualification proceedings.

As a senior member of the CMA’s Legal Service, you will manage litigation case teams and lead the conduct of proceedings in all our civil litigation, working collaboratively with relevant project teams as well as external counsel. You will also have a wider role in helping decision makers across the CMA to identify and manage litigation risk in their investigations and decision making, working closely with other colleagues in the CMA’s Legal Service. The role will involve high level engagement throughout the CMA and externally.  The Litigation Directors have joint responsibility for leadership and management of the CMA’s Litigation Group, reporting directly to the General Counsel, but also form part of the wider leadership and management team for the CMA’s Legal Service. 

You will need extensive experience in the Competition Appeal Tribunal and/or High Court or their equivalent, a track record of effective leadership and strong team working skills, combined with strong communication skills, and a proven capacity for strategic thinking. Significant experience of leading competition and/or consumer litigation is highly desirable.
